This is where a Power of Attorney (PoA) can make the process considerably easier. By granting specific powers to a trusted legal representative, a buyer may be able to complete important stages of the purchase without being physically present in Spain.

What is a Power of Attorney?
A Power of Attorney is a legal document that allows you to authorise another person to act on your behalf for specific purposes.
When buying property in Spain, the powers granted can be tailored to the transaction. Depending on the circumstances, your representative may be authorised to:
- Sign reservation or deposit agreements.
- Review and sign purchase documentation.
- Carry out legal and administrative procedures.
- Attend the notary appointment.
- Sign the public deed of sale.
- Deal with certain tax and registration formalities.
- Complete relevant post-completion procedures.
The powers included in the document should be clearly defined and limited to what is necessary for the transaction.
Do you have to travel to Spain to buy a property?
Not necessarily.
A properly prepared Power of Attorney can allow your Spanish lawyer to represent you during key stages of the purchase, including completion before a Spanish notary.
This can be particularly useful when the buyer is living permanently abroad or is unable to travel to Spain at the time of completion.
The way the Power of Attorney is granted will depend on the buyer’s circumstances. It may be possible to arrange it through a Spanish Consulate or before a notary in the buyer’s country of residence.
If the document is signed before a foreign notary, it may need to be apostilled and officially translated into Spanish before it can be used in Spain.
What can your Spanish lawyer do on your behalf?
Using a Power of Attorney does not mean handing over control of your property purchase.
Your lawyer’s role is to carry out the actions you have authorised while keeping you informed throughout the process.
A Power of Attorney can allow your lawyer to manage several key stages of the purchase, including:
Checking the property
Your lawyer can carry out the relevant legal due diligence to identify potential issues affecting the property.
Managing the contracts
Purchase contracts and other documentation can be reviewed and signed on your behalf where authorised.
Attending the notary
Your legal representative can attend the completion appointment and sign the public deed on your behalf.
Handling taxes and registration
Tax, registration and other administrative formalities can also be coordinated on your behalf.
