From the last quarter of 2026, the way in which millions of people enter European territory will undergo a fundamental change. If you are planning to travel to Europe or settle in our country, it is essential that you understand the new Schengen entry requirements that will soon come into force.

At Fuster & Associates, as experts in immigration law and legal advice in Spain, we want to provide you with detailed information about the ETIAS (European Travel Information and Authorisation System), a measure designed to strengthen border security without removing the visa exemption for citizens of over 60 countries.

What is the ETIAS Authorisation?

The ETIAS is a pre-travel authorisation system, designed for nationals of countries that currently do not require a visa for short stays in the Schengen area.

!

It is important to note that ETIAS is not a visa. Unlike a complex consular process, it is a quick electronic authorisation, similar to the US ESTA system or Canada’s eTA.

The European Union is implementing this system with several strategic objectives:

  • Enhancing security: It enables the identification of potential security risks before the traveller reaches the external borders.
  • Migration control: It helps prevent irregular migration and better manage visitor flows.
  • Digitalisation: It modernises border controls and streamlines border crossings for authorised travellers.
  • Public health protection: It facilitates the early detection of health risks.

Who Needs ETIAS to Enter Spain?

This new requirement will be mandatory for all travellers from visa-exempt countries wishing to enter any of the 30 European countries in the Schengen Area, including major destinations such as Spain, France, Italy and Germany.

Among the nationalities required to apply for the ETIAS authorisation are citizens of:

  • Latin America: Argentina, Mexico, Brazil, Chile, Colombia, Peru and Uruguay, amongst others.
  • North America: the United States and Canada.
  • Others: the United Kingdom, Australia, Japan and South Korea.
For the full and updated official list of countries required to obtain ETIAS, you can consult the European Union’s official information.

Important exemptions

Not all foreign nationals require this authorisation. The following are exempt:

  • Citizens of the European Union and Schengen Area countries.
  • Foreign nationals who already hold a residence permit (TIE) in Spain or a long-stay visa.
  • People travelling on a traditional Schengen visa that has already been approved.

Application Process

The ETIAS application process has been designed to be a streamlined, digital process carried out entirely online.

How to apply

Applicants must visit the official ETIAS website or use the ETIAS mobile app to complete a form containing personal details, passport information and security and health questions. The process usually takes less than 10 minutes.

Cost of the authorisation

The official fee set by the European Union is 20 euros per application. However, there are exemptions from payment for:

  • Those under 18 years of age.
  • Those over 70 years of age.
  • Family members of EU citizens (in certain cases).

Validity & processing time

Once approved, the authorisation will be valid for 3 years or until the passport expires, whichever comes first. During this time, it allows multiple entries for stays of up to 90 days within a 180-day period.

As for processing time, most applications are approved within minutes or hours. However, if further review is required, the process could take up to 14 or even 30 days in exceptional cases.

What to Do in the Event of a Refusal?

If an application for an ETIAS authorisation is refused, the system will send an email explaining the reasons for the decision. The applicant has the right to appeal the decision in accordance with the legislation of the country that issued the refusal.

In many cases, the refusal is due to errors on the form or previous immigration alerts. In the event of a refusal, it is highly recommended to seek specialist legal advice to assess the possibility of an appeal or applying for a conventional visa at the relevant consulate.

Tips for Entering Spain Smoothly

Although ETIAS facilitates travel, having it does not automatically guarantee entry into Spanish territory. Upon arrival, border officials will verify that all Schengen entry requirements are met, such as:

  1. Valid passport: It must be valid for at least three months after the planned departure.
  2. Proof of accommodation: Hotel booking or letter of invitation.
  3. Financial means: Proof of sufficient funds for the stay.
  4. Medical insurance: Health cover for the duration of the trip.
  5. Return ticket: Proof that the traveller will leave the Schengen area.
!

It is vital to submit the application at least 72 hours before travelling to avoid any unforeseen issues. Without a valid authorisation, airlines will refuse boarding.
