Details and processes on the new Foreigners’ Identity Card – TIE – for British citizens who have to change their legal status when they are no longer European citizens on 31/12/20
On Saturday 04/07/20, the Resolution of 2 July 2020 was published in the Official State Bulletin (BOE), by the Sub-secretary, by which the Joint Instruction of the General Direction of Migration and the General Direction of the Police is published, determining the procedure for the issue of the residence document provided for in Article 18.4 of the Agreement on the Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community.
Who can apply for the new identification card for British nationals in Spain?
(a)If the British Citizen holds a temporary registration certificate (green card) and has not reached five years’ legal residence in Spain, he/she may apply in person to the police authorities to be established for the issue of a residence document.
(b) If the British Citizen is the holder of a temporary registration certificate and has reached 5 years of legal residence in Spain (without having obtained, prior to applying for this residence document, a permanent registration certificate), he/she may apply in person to the police station to be established for the issue of the residence document which, after verification of the duration of residence, will issue it.
(c)If the British Citizen is the holder of a permanent registration certificate, he/she may apply in person to the police authorities to be established for the residence document to be issued.
(d)If the British Citizen does not hold a certificate of registration, he may apply for this residence document in person or through his representative at the Oficina de extranjería (Foreigners Office) in the region in which he/she resides or intends to take up residence. Once you have obtained this application, you must go to the corresponding police station within one month and apply for a residence card.
What documents must be submitted to apply for the new ID card?
- Application form -EX 23 Application for card.
- Valid and current passport of the applicant. In the event that the passport is expired, a copy of this and the application for renewal must be provided.
- Proof of payment of the corresponding fee.
- A photograph, in accordance with the requirements laid down in the regulations on national identity cards.
How valid is the new British ID card?
This residence document will be valid for five to ten years, depending on the case, and in the field corresponding to the Type of Permit the term “Temporary” or “Permanent” will be indicated as appropriate.
If the validity is 5 years, those who have reached 5 years of legal residence in Spain will be able to access permanent residence which will be valid for 10 years. Once its validity has expired, it must be automatically renewed.
