La Haute Cour de justice de l’UE juge que l’IRPH est potentiellement abusif

La Cour de justice de l’UE a rendu son arrêt sur l’indice hypothécaire espagnol controversé IRPH.

Dans l’arrêt rendu le 3 mars, la CJUE a déclaré que les tribunaux espagnols doivent déterminer si les clauses sont suffisamment « claires et compréhensibles » et que lorsque ce n’est pas le cas, l’IRPH doit être remplacé par un autre indice supplémentaire officiel, tel que l’Euribor.

La Cour de justice de l’UE avertit que la clause « doit non seulement être compréhensible sur le plan formel et grammatical, mais elle doit aussi permettre au consommateur moyen – généralement bien informé et raisonnablement attentif et perspicace – d’être en mesure de comprendre le fonctionnement spécifique du mode de calcul dudit type d’intérêt et d’évaluer ainsi, sur la base de critères précis et compréhensibles, les conséquences économiques potentiellement importantes de ces clauses pour ses obligations financières ».

La Haute Cour de justice de l’UE précise que la banque doit également fournir des informations sur l’évolution de l’indice, ce qui ouvre la porte à l’annulation de cette clause en raison de son manque de transparence en cas de non-respect.

Toutefois, la CJUE n’a pas déclaré la nullité de l’indice lui-même, laissant aux juges le soin de décider au cas par cas si celui-ci est abusif.
