Une augmentation de la valeur de transfert signifie plus d&rsquo;imp\u00f4ts \u00e0 payer en cas de b\u00e9n\u00e9fice et d&rsquo;\u00e9ventuelles p\u00e9nalit\u00e9s aupr\u00e8s de l&rsquo;Administration fiscale espagnole (AEAT).<\/p>\n<h2><strong>\u00c0 quoi peut ressembler ce sc\u00e9nario?<\/strong><\/h2>\n<p>Exemple de paiement de l&rsquo;imp\u00f4t estim\u00e9 en Espagne, avec une propri\u00e9t\u00e9 d&rsquo;une valeur de 300 000 \u20ac et des meubles d&rsquo;une valeur de 20 000 \u20ac correctement accr\u00e9dit\u00e9s dans le titre de propri\u00e9t\u00e9.<\/p>\n<p>Prix de vente : 300 000 \u20ac.<\/p>\n<p>Plus-value possible : 150 000 \u20ac.<\/p>\n<p>Imposition pour les non-r\u00e9sidents de l&rsquo;UE \u00e0 19 % : 28 500 \u20ac.<\/p>\n<p>&nbsp;<\/p>\n<p>Exemple de paiement de l&rsquo;imp\u00f4t estim\u00e9 en Espagne, avec une valeur de la propri\u00e9t\u00e9 de 300 000 \u20ac et des meubles de 20 000 \u20ac incorrectement cr\u00e9dit\u00e9s dans le titre de propri\u00e9t\u00e9.<\/p>\n<p>Prix de vente : 320 000 \u20ac.<\/p>\n<p>Plus-value possible : 150 000 \u20ac.<\/p>\n<p>Imp\u00f4t pour les non-r\u00e9sidents de l&rsquo;UE : 19% : 32.300\u20ac.<\/p>\n<p>Comme le montre l&rsquo;exemple, il y a une diff\u00e9rence dans le montant \u00e0 payer aux autorit\u00e9s fiscales qui doit \u00eatre prise en compte dans la vente de propri\u00e9t\u00e9s avec des meubles.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Mais qu&rsquo;en est-il de l&rsquo;acheteur, peut-il avoir des probl\u00e8mes si la valeur des meubles est ajout\u00e9e \u00e0 la valeur de la propri\u00e9t\u00e9 par le bureau des imp\u00f4ts ?<\/strong><\/h3>\n<p>Oui, l&rsquo;acheteur doit savoir que si l&rsquo;AEAT augmente la valeur de la propri\u00e9t\u00e9, cette information peut \u00e9galement \u00eatre transmise au bureau des imp\u00f4ts de chaque Comunidad Aut\u00f3noma et l&rsquo;acheteur peut avoir \u00e0 payer un montant plus \u00e9lev\u00e9 dans l&rsquo;imp\u00f4t sur les transferts.<\/p>\n<p>En effet, l&rsquo;imp\u00f4t sur le transfert de meubles peut \u00eatre de 4 ou 6 %, mais l&rsquo;imp\u00f4t sur le transfert de propri\u00e9t\u00e9s peut \u00eatre de 8 ou 10 % selon la Comunidad Aut\u00f3noma.<\/p>\n<p>Il ne faut pas oublier que l&rsquo;imp\u00f4t sur les transferts est un imp\u00f4t qui est pay\u00e9 en % et qui varie en fonction de la Communaut\u00e9 autonome.<\/p>\n<p>Par cons\u00e9quent, en suivant l&rsquo;exemple ci-dessus, un acheteur d&rsquo;Alicante paiera sur un achat de 20.000\u20ac de meubles avec des factures bien document\u00e9es :<\/p>\n<p>Exemple lorsque le prix d&rsquo;achat est de 300.000\u20ac.<\/p>\n<p>Le PTI \u00e0 Alicante est de 10%, l&rsquo;acheteur paiera 30.000\u20ac.<\/p>\n<p>Exemple si l&rsquo;AEAT r\u00e9vise et augmente la valeur du mobilier, 20.000\u20ac.<\/p>\n<p>Prix d&rsquo;achat : 320.000\u20ac.<\/p>\n<p>Le PTI \u00e0 Alicante est de 10%, l&rsquo;acheteur paiera 32.000\u20ac.<\/p>\n<h4><strong>Comment un non-r\u00e9sident peut-il vendre ou acheter correctement un bien meubl\u00e9 ?<\/strong><\/h4>\n<p>Afin de prouver le prix d&rsquo;achat du mobilier au bureau des imp\u00f4ts, les factures d&rsquo;achat doivent \u00eatre fournies et dans la plupart des cas, cela ne peut \u00eatre fait car les factures ne peuvent \u00eatre localis\u00e9es.<\/p>\n<h4><\/h4>\n<h4><strong>Alors comment \u00e9viter que le prix du mobilier soit ajout\u00e9 \u00e0 la valeur du bien ?<\/strong><\/h4>\n<p>Pour \u00e9viter cela, il faut prouver que ces meubles ne faisaient PAS partie du bien au moment de l&rsquo;achat et n&rsquo;\u00e9taient donc pas inclus dans le prix d&rsquo;achat.<\/p>\n<p>Il faut donc le justifier par \u00e9crit :<\/p>\n<ol>\n<li>L&rsquo;existence du mobilier et sa date d&rsquo;acquisition.<\/li>\n<li>La valeur de cession du mobilier, avec les factures et si possible, son paiement.<\/li>\n<\/ol>\n<h3><strong>Ce que nous recommandons,<\/strong><\/h3>\n<p>Chez Fuster &amp; Photos avant le bien sans meubles et apr\u00e8s le bien avec meubles.<\/p>\n<p>&#8211; L&rsquo;inventaire du bien \u00e9valu\u00e9 et sign\u00e9 par l&rsquo;acheteur et le vendeur doit \u00eatre inclus dans le contrat et dans le titre de propri\u00e9t\u00e9.<\/p>\n<p>&#8211;
