{"id":18767,"date":"2022-05-19T17:35:11","date_gmt":"2022-05-19T15:35:11","guid":{"rendered":"https:\/\/fuster-associates.com\/?p=18767"},"modified":"2022-06-27T18:08:49","modified_gmt":"2022-06-27T16:08:49","slug":"garantie-nouvelles-constructions","status":"publish","type":"post","link":"https:\/\/fuster-associates.com\/fr\/blog\/garantie-nouvelles-constructions\/","title":{"rendered":"Lorsqu&rsquo;on investit dans un nouveau d\u00e9veloppement, Fuster &#038; Associates garantit la s\u00e9curit\u00e9."},"content":{"rendered":"<h2>Une banque doit restituer 38 500 euros aux acheteurs d\u2019une urbanisation frustr\u00e9e de Moratalla<\/h2>\n<p class=\"csC583D0C8\"><span class=\"cs9B40B68F\">L\u2019audience confirme l\u2019obligation de l\u2019institution financi\u00e8re de r\u00e9pondre aux clients pour le non-respect du contrat de la part du promoteur, qui n\u2019avait pas de licence.<\/span><\/p>\n<p class=\"csC583D0C8\"><span class=\"cs9B40B68F\">CaixaBank, garant du promoteur en faillite Progofer Calidad S.L., doit restituer plus de 38 500 euros \u00e0 plusieurs acheteurs qui ont transf\u00e9r\u00e9 des acomptes pour l\u2019urbanisation El Balc\u00f3n de Moratalla, qui a \u00e9t\u00e9 promue en 2007 dans cette ville et ne s\u2019est jamais concr\u00e9tis\u00e9e.<\/span><\/p>\n<p class=\"csC583D0C8\"><span class=\"cs9B40B68F\">Ceci est \u00e9tabli par deux jugements de tribunaux de premi\u00e8re instance de Murcie -maintenant confirm\u00e9s par le tribunal-, qui estiment le proc\u00e8s pr\u00e9sent\u00e9 par l\u2019avocat Jos\u00e9 Ignacio S\u00e1nchez Villa, du cabinet Fuster &amp; Associates. Ces acheteurs ont r\u00e9clam\u00e9 \u00e0 la banque l\u2019argent qu\u2019ils avaient anticip\u00e9, entre novembre 2007 et mai 2008, pour l\u2019achat de leurs futures maisons qui n\u2019ont jamais \u00e9t\u00e9 construites. Un tribunal enqu\u00eate pour savoir si une escroquerie pr\u00e9sum\u00e9e est trouv\u00e9e derri\u00e8re ce projet non abouti.<\/span><\/p>\n<p class=\"csC583D0C8\"><span class=\"cs9B40B68F\">Selon les d\u00e9cisions, l\u2019entit\u00e9 a fait valoir que les montants vers\u00e9s n\u2019\u00e9taient pas des avances sur le prix de la vente, mais des d\u00e9p\u00f4ts p\u00e9nitentiels.
