Nogle reservationskontrakter indeholder ikke meget mere end:<\/p>\n<ul>\n<li>Identifikation af parterne.<\/li>\n<li>En vejledende pris.<\/li>\n<li>Det betalte depositum.<\/li>\n<li>Den periode, hvor ejendommen er \u00bbreserveret\u00ab.<\/li>\n<\/ul>\n<p>Og det kan efterlade alt for mange aspekter uregulerede.<\/p>\n<div style=\"height: 30px;\"><\/div>\n<h3>Den st\u00f8rste risiko ved reservationskontrakten<\/h3>\n<p>Problemet er ikke selve dokumentet, men <strong>hvordan det er udformet<\/strong>.<\/p>\n<p>Nogle reservationskontrakter:<\/p>\n<ul>\n<li>Angiver ikke, hvad der sker, hvis k\u00f8beren tr\u00e6kker sig tilbage.<\/li>\n<li>Angiver ikke, om depositummet kan refunderes.<\/li>\n<li>Omhandler ikke skjulte omkostninger eller planl\u00e6gningssp\u00f8rgsm\u00e5l.<\/li>\n<li>Pr\u00e6ciserer ikke, hvad der sker, hvis s\u00e6lgeren ombestemmer sig.<\/li>\n<li>Indeholder tvetydige klausuler, der er udarbejdet af ejendomsm\u00e6glere uden juridisk tilsyn.<\/li>\n<\/ul>\n<p>Resultatet er som regel det samme: tvister om tilbagebetaling af pengene.<\/p>\n<p>I mange tilf\u00e6lde opdager k\u00f8beren, at vedkommende har betalt flere tusinde euro uden nogen <strong>reel beskyttelse<\/strong>.<\/p>\n<div style=\"height: 30px;\"><\/div>\n<h3>Hvad er en depositumskontrakt?<\/h3>\n<p>En depositumskontrakt er en langt mere robust og bindende kontrakt.<\/p>\n<p>I mods\u00e6tning til en reservation er der normalt en formel forpligtelse til k\u00f8b og salg mellem k\u00f8ber og s\u00e6lger.<\/p>\n<p>Dokumentet indeholder typisk:<\/p>\n<ul>\n<li>Ejendommens endelige pris.<\/li>\n<li>Betalingsm\u00e5de.<\/li>\n<li>Frister for gennemf\u00f8relse af ejendomsretsoverdragelsen.<\/li>\n<li>Fordeling af omkostninger og afgifter.<\/li>\n<li>Juridiske konsekvenser ved misligholdelse.<\/li>\n<\/ul>\n<p>Desuden medf\u00f8rer et depositum normalt en klar \u00f8konomisk sanktion, hvis en af parterne bryder aftalen.<\/p>\n<div style=\"height: 30px;\"><\/div>\n<h3>De tre typer depositum i Spanien<\/h3>\n<p>Et af de aspekter, som mange k\u00f8bere ikke kender til, er, at ikke alle depositum fungerer p\u00e5 samme m\u00e5de.<\/p>\n<div style=\"height: 10px;\"><\/div>\n<h4>1. Fortrydelsesdepositum<\/h4>\n<p>Disse er de mest almindelige i <strong>bolighandler<\/strong>.<\/p>\n<p>De giver mulighed for at tr\u00e6kke sig ud af kontrakten:<\/p>\n<ul>\n<li>K\u00f8beren mister det betalte bel\u00f8b.<\/li>\n<li>S\u00e6lgeren tilbagebetaler det dobbelte bel\u00f8b, hvis vedkommende bryder kontrakten.<\/li>\n<\/ul>\n<p>De er reguleret af artikel 1454 i civilloven.<\/p>\n<div style=\"height: 10px;\"><\/div>\n<h4>2.
